You can still face marijuana charges in Michigan

Michigan has legalized marijuana for recreational use. This has been true for years, as legalization occurred in 2018 and sales began in 2019. Even before that, Michigan had a medical marijuana program, so many users were already accustomed to being able to legally purchase and use marijuana products.

That being said, it is very important for Michigan residents to understand that they can still face marijuana charges for a variety of reasons. Legalization does not make that impossible, and those who are facing charges must understand what legal options they have.

Illegal purchases or sales

For instance, the only entities that are allowed to sell recreational marijuana are authorized dispensaries. Someone else who is selling on an individual level could still face charges. Similarly, people have to be at least 21 years old to buy recreational marijuana, so sales or purchases by underage individuals could result in legal charges.

Driving under the influence

Just like driving under the influence of alcohol is illegal, driving while high is also banned. This extends to more than just passenger cars or commercial trucks. People in Michigan could also face charges for driving snowmobiles in the winter or boats during the summer months.

Travel restrictions

Finally, marijuana may be legal in Michigan, but taking those products to other states can result in legal charges. This could come at the state level if marijuana has not been legalized in the other state, or it could be a federal violation if someone crosses state lines with marijuana.
