Michigan laws dealing with substances used to make meth

On Behalf of | Feb 29, 2024 | Criminal Defense |

Methamphetamine is classified as a Schedule II controlled substance in Michigan, which means lawmakers have determined that the drug is highly addictive but has some medical uses. Unlike marijuana, heroin and cocaine, methamphetamine is made from chemicals rather than plants. Purchasing pseudoephedrine and ephedrine, which are substances that are used to manufacture methamphetamine, is also strictly controlled in Michigan. Both pseudoephedrine and ephedrine have legitimate medical uses and can be found in dozens of over-the-counter medications, so purchasing them in small quantities is perfectly legal.

Purchasing or possessing pseudoephedrine and ephedrine

People find themselves on the wrong side of the law when they purchase large amounts of pseudoephedrine or ephedrine or large quantities of over-the-counter products that contain the substances. Purchasing more than 3.6 grams of either substance in a day, more than 9 grams of either substance in a 30-day period and possessing more than 12 grams of either substance violates Michigan law. Purchasing or possessing any quantity of pseudoephedrine or ephedrine with the intent to manufacture methamphetamine is also a criminal offense in Michigan.

Pseudoephedrine and ephedrine penalties

Purchasing more than 3.6 grams of pseudoephedrine or ephedrine in a day or more than 9 grams of either substance during a 30-day period is a misdemeanor offense in Michigan punishable by up to 93 days in jail and a fine of up to $500. Possessing more than 12 grams of either substance is a felony drug crime in Michigan that carries a prison sentence of up to two years and a fine of up to $2,000. Possessing or purchasing any amount of pseudoephedrine or ephedrine with the intent to manufacture methamphetamine is also a felony in Michigan. This offense is punishable by up to five years in prison and a fine of up to $5,000.

Manufacturing methamphetamine

Methamphetamine is a synthetic drug, and some of the substances used to manufacture it can be purchased in any pharmacy or drug store. To prevent people from being able to manufacture methamphetamine, Michigan law prohibits the purchase or possession of unusually large quantities of pseudoephedrine or ephedrine. Individuals who violate these drug laws can be charged with misdemeanors or felonies, and they can be sent to prison for up to five years if they intend to use pseudoephedrine or ephedrine to manufacture methamphetamine.
